These Terms of Use govern your use of the eTNTPlus website and all applications, software, and services available on the website.

 

Acceptable Use

As a condition of your use of eTNTPlus operated by Logistics Plus, Inc. ("eTNTPlus") via your web browser, you agree that you will not use eTNTPlus, or any information obtained from eTNTPlus, for any purpose that is unlawful or prohibited by any other agreement that you may have with Logistics Plus, including among other things, the provisions of these Terms of Use. You shall abide by all applicable local, state, national and international laws and regulations. You shall be solely responsible and liable for maintaining the confidentiality of any account name and/or password(s) that may be issued to you by Logistics Plus, Inc. in connection with your use of eTNTPlus. You shall not and shall not assist or permit others in (a) using eTNTPlus to; or (b) conduct any activities, which directly or indirectly results in any of the following:

• Defame, abuse, harass, stalk, threaten or otherwise violate or infringe the legal rights (such as rights of privacy, publicity, ownership and intellectual property) of others or Logistics Plus;

• Publish, ship, distribute or disseminate any harmful, inappropriate, profane, vulgar, infringing, obscene, false, fraudulent, tortious, indecent, unlawful, immoral or otherwise objectionable material or information (including without limitation any unsolicited commercial communications);

• Publish, ship, distribute or disseminate material or information that encourages conduct that could constitute a criminal offense or give rise to civil liability;

• Engage in any conduct that could constitute a criminal offense or give rise to civil liability for Logistics Plus;

• Misrepresent or in any other way falsely identify your individual identity or affiliation with any employer or entity on behalf of whom you may be performing services, including without limitation through impersonation or altering any technical information in communications with Logistics Plus or others arising out of use of eTNTPlus;

• Transmit or upload any material to eTNTPlus that contains viruses, trojan horses, worms, time bombs, cancelbots, or any other programs with the intent or effect of damaging, destroying, disrupting or otherwise impairing any function of eTNTPlus;

• Interfere with or disrupt eTNTPlus, networks or servers connected to eTNTPlus or violate the regulations, policies or procedures of such networks or servers, including without limitation altering the appearance of eTNTPlus user interfaces or altering any of the information submitted to internet authorities for proper access to eTNTPlus from the internet;

• Attempt to gain unauthorized access to eTNTPlus, any software made available by Logistics Plus through eTNTPlus, other accounts, computer systems or networks connected to eTNTPlus, through password mining or any other means;

• Interfere with another party’s use of eTNTPlus or another individual's or entity's use of similar service;

• Violate any Logistics Plus security technologies, procedures or policies; or

• Attempt to probe, scan, or test the vulnerability of eTNTPlus or any networks or servers connected to eTNTPlus.

Logistics Plus reserves the right (but has no obligation) at all times to monitor, review, retain and/or disclose any information relating to use of eTNTPlus as necessary to satisfy or cooperate with any applicable law, regulation, legal process or governmental request. You shall immediately notify Logistics Plus of any unauthorized use of any account or password issued to you in connection with eTNTPlus or any known breach of your agreements with Logistics Plus, including without limitation these Terms of Use.

Intellectual Property

The trademarks eTNTPlus and Logistics Plus, names and logos displayed on this website are registered trademarks of Logistics Plus, Inc. No user has the license or right to use any trademark without the prior written permission of Logistics Plus, Inc.

Revisions

Logistics Plus may revise the terms and conditions at any time and these revisions will be binding and effective immediately. The continued use of the website indicates agreement to the terms and conditions and any modifications.

Limitation of Liability

In no event shall Logistics Plus have any liability for any incidental, consequential, indirect, special or punitive damages or loss of profits arising out of or in connection with this agreement, regardless of the form of the action, whether in contract, tort (including negligence), strict product liability, or otherwise.

Jurisdiction

These Terms of Use are governed by the laws of the Commonwealth of Pennsylvania. You expressly agree that any proceeding arising out of or relating to your use of the eTNTPlus website shall be in a state or federal court in the County of Erie and the Western District of Pennsylvania.

General

You may not assign these terms of use or any of your interests, rights, or obligations under these terms of use. If any provision of these terms of use is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms of Use, which shall remain in full force and effect. No waiver of any of these Terms of Use shall be deemed a further or continuing waiver of such term or condition or any other term or condition.
